By accessing or using the OnlineDonations Fundraising Service (the “Service”) through the gofundus.us website (the “Website”), you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use (the “Terms”) and our Privacy Policy.
The Service is an internet-based platform that enables your organization to connect with potential donors, facilitate contributions, and provide tools to manage your fundraising efforts. You agree to use the Service solely for legitimate fundraising purposes and to respect the privacy of all donors and participants.
We provide tools, including computer-assisted email personalization based on information you supply, and host a customizable webpage through which potential donors may contribute. You maintain full control over the design and content of this webpage.
Funds Collected
All donations made through the Service are received by us, a registered professional solicitor, in compliance with South Carolina law. Each organization is responsible for consulting its Secretary of State to determine applicable registration requirements and exemptions prior to conducting a campaign.
Unless otherwise noted, all funds collected (less applicable administrative fees) will be remitted within 10 days of the campaign’s designated end date. Approved fund managers will always have full access and transparency into collections and reporting.
Terms and Termination
These Terms apply to all use of the Service. We reserve the right to suspend or terminate access at any time. The following provisions survive termination: proprietary rights, disclaimers, indemnities, and limitations of liability.
The Website and its content may only be used for personal, non-commercial purposes. Except as expressly authorized, you may not copy, modify, publish, distribute, display, or sell any proprietary materials, including content posted to the Website. Fundraising content may not be promoted or shared without the consent of both parties.
We retain all intellectual property rights in the Website, including its software, tools, documentation, designs, data, and content of any kind (text, images, graphics, video, audio, and logos). You agree to indemnify and hold OnlineDonations harmless from any claims, damages, or costs (including attorney’s fees) arising from your use of the Service.
Changes to Terms
We may update, modify, or discontinue the Service or these Terms at any time, without notice or liability. Continued use of the Service constitutes acceptance of the then-current Terms. If changes are unacceptable to you, you must immediately notify us and discontinue use of the Service.
General Provisions
These Terms represent the entire agreement between you and OnlineDonations regarding the Service. You may not assign or delegate your rights or obligations without prior written consent. Any unauthorized attempt to do so is void.
Any waiver of these Terms must be in writing and signed by the party granting the waiver, and shall not constitute a waiver of future rights.
All disputes must be submitted in writing to our office within 30 days. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
